Chairperson and Vice-Chairperson are appointed from within the Board membership. The appointment is made by the Premier, in consultation with the Board.

As per the Waters Act and Umbrella Final Agreement, membership is from 4 to 9 people, appointed by the Minister of Executive Council. At least three persons are nominated by the Government Leader, one-third of the members are nominated by CYFN, and the remaining members are nominated by the federal government departments that are most directly concerned with the management of waters. Board members are not delegates of the parties who nominate them.

An appointment replacing a member whose term has not expired can only be for the unexpired portion of that term.
